Terms of Service

Welcome to Binaax. These Terms govern your use of our website-builder service at binaax.app (the Service). By creating an account or using the Service, you agree to these Terms.

You must be at least 18 years old and legally able to enter contracts in your jurisdiction. If you're using Binaax on behalf of a business, you represent that you have authority to bind that business to these Terms.

You're responsible for keeping your account credentials secure. We reserve the right to suspend or terminate accounts that violate these Terms or are used in fraud, harassment, or other abuse.

You retain ownership of everything you create on Binaax — your business description, generated site content, uploaded images, copy, and edits. You grant us a limited license to host, display, and process your content solely as required to operate the Service.

You are responsible for ensuring your content doesn't infringe any third-party rights or applicable laws (no trademark infringement, no copyrighted images you don't have rights to, etc.).

You agree not to use Binaax to:

• Sell illegal goods or services
• Distribute malware, phishing pages, or fraud schemes
• Impersonate other people or businesses
• Abuse, harass, or stalk anyone
• Distribute hateful, violent, or sexually explicit content
• Reverse-engineer, scrape, or attack the Service
• Resell access to the Service without our prior written consent

We may take down sites that violate these rules without prior notice and refer egregious abuse to law enforcement.

Some features (notably publishing your site) require payment via Paystack. The plan you select at checkout governs the amount, currency, and recurrence. Prices are displayed in the publish modal at the time of payment.

For recurring plans (monthly, yearly), you pay each period to maintain access. If your subscription expires:

• For plans configured to keep sites live after expiry: your live URL stays online but you can't push updates until you renew.
• For plans configured to take sites offline: your live URL serves a temporary offline page until you renew.

Refunds are at our discretion. Contact hi@stackjunior.com within 7 days of payment if you have a refund request.

We aim for high availability but don't guarantee uninterrupted service. We may perform scheduled maintenance, deploy updates, or experience outages from upstream providers (hosting, CDN, payment processor). When practical we'll notify users in advance.

You may delete your account at any time from your dashboard. We may suspend or terminate accounts for violations of these Terms or prolonged inactivity. On termination, your sites are taken offline and your project data is deleted per our Privacy Policy retention schedule.

The Service is provided “as is” and “as available”. We don't warrant that the Service will be error-free, secure, or meet your specific business goals. AI-generated content may contain inaccuracies — review what's generated before making business decisions.

To the maximum extent permitted by law, Binaax's aggregate liability for any claim arising out of or related to the Service is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages, including lost profits or lost data.

You agree to indemnify Binaax from claims arising out of (a) content you publish on the Service, (b) your violation of these Terms, or (c) your violation of third-party rights.

These Terms are governed by the laws of the Federal Republic of Nigeria. Disputes will be resolved in the courts of Lagos State unless otherwise required by mandatory consumer-protection law.

We may update these Terms. Significant changes will be communicated via email or a prominent in-app notice. Continued use of the Service after changes constitutes acceptance.
